Quick answer: The normal security deposit in Mehrauli is one month’s rent, and two months is the most current listings ask. A typical 1 BHK at ₹12,000 a month therefore needs a deposit of ₹12,000 to ₹24,000. No Delhi law that can be confirmed caps the deposit on a new private lease, so the signed agreement decides the amount, the refund date and the deductions.

SouthDelhi Rentwala lists the deposit each Mehrauli landlord asks. The quote names an amount and almost never a refund date, and the refund date is what a tenant needs most. This page covers both, along with the law, which is general information and not legal advice. The wider context sits in the Mehrauli renting guide.

How much security deposit is normal in Mehrauli

The normal security deposit in Mehrauli is one month’s rent. Some furnished and high-rent flats ask two months, and no current listing on SouthDelhi Rentwala asks for more. For a typical 1 BHK at ₹12,000 a month, that means a deposit of ₹12,000, or ₹24,000 at the two-month ceiling.

Monthly rentOne monthTwo monthsThree months
₹8,000₹8,000₹16,000₹24,000
₹12,000 (typical 1 BHK)₹12,000₹24,000₹36,000
₹23,000 (typical 2 BHK)₹23,000₹46,000₹69,000
₹30,000 (fully furnished 1 BHK)₹30,000₹60,000₹90,000

Plan the cash for two months and expect to pay one. National guides quote two to three months for Delhi as a whole, and a landlord outside the SouthDelhi Rentwala network may ask for that. Two months is also the limit the Model Tenancy Act 2021 proposes, so it is the figure that rarely looks unreasonable.

The gap matters on day one. A semi-furnished 1 BHK at ₹11,000 rent and ₹700 maintenance needs ₹22,700 in cash with a one-month deposit and ₹33,700 with two, as flat rent in Mehrauli explains for the first-month costs.

Two months is a ceiling, not a rule, and one building shows how loosely it is applied.

What security deposit do 1 BHK and 2 BHK flats in Mehrauli carry

A 1 BHK in Mehrauli usually carries a security deposit of ₹12,000 to ₹24,000, and a 2 BHK ₹23,000 to ₹46,000, at one to two months of the typical rent. Across every flat on the market the ranges run wider: ₹5,250 to ₹65,199 for a 1 BHK and up to ₹80,000 for a 2 BHK.

Rent and deposit ranges for flats on the market in Mehrauli, October 2026. The last column divides the top deposit by the top rent.

The last column is a calculation, not a measured deposit, because the top deposit and the top rent belong to different flats. It still shows the pattern: the highest deposits sit near two months of the highest rent. Independent houses are the one type that edges past it, at about 2.4.

The bottom of each range tells the same story. A 1 BHK at ₹6,600 carries a ₹6,600 deposit, one month exactly.

Which flats sit at the top of those ranges depends on a choice the landlord makes, not on the building.

Which Mehrauli flats ask for a two-month security deposit

Two-month deposits appear on fully furnished flats at ₹19,999 a month or more, such as Silver Oakwood Apartment at ₹30,000, Green Valley Apartment at ₹22,000 and one Sidh Kunj Apartment flat at ₹19,999. One unfurnished 2 BHK in Ward 8 also asks two months, at ₹13,000 rent.

Sidh Kunj Apartment shows how personal the number is. It lists three flats at about ₹20,000 a month. Two ask a one-month deposit and the third asks two months, so the quote follows the landlord and not the building or the rent.

A landlord’s exposure has two parts, the notice period and the contents of the flat. Notice periods on Mehrauli listing pages run from none to two months. A one-month deposit covers only half of a two-month notice before any damage, which is a likely reason furnished landlords ask for more.

Furnishing alone does not set the amount. Most fully furnished flats on SouthDelhi Rentwala still ask one month, and furnished vs unfurnished flats in Mehrauli lists what a furnished flat includes, which is the basis for an inventory.

Whether a landlord may ask for two months at all is a legal question.

Is there a legal limit on security deposit in Mehrauli

No confirmed legal limit applies to a security deposit on a new private lease in Mehrauli. The two-month cap on residential deposits comes from the Model Tenancy Act 2021, a template that states and union territories must adopt through their own laws, and Delhi has not been shown to have adopted it.

RuleWhat it says about depositsWhom it reaches
Model Tenancy Act 2021Residential deposit of at most two months’ rent, non-residential at most six months. Refund when the landlord takes back vacant possession.Only where a state or union territory enacts it. Delhi adoption is not shown.
Delhi Rent Control Act 1958Section 5(2)(b): advance rent above one month needs the Rent Controller’s permission.Excludes premises with monthly rent above ₹3,500.
Signed rent agreementThe amount, refund date and deduction terms that both sides sign.Every new tenancy.

The Union Cabinet approved the Model Tenancy Act 2021 on June 2, 2021, and sent it to the states and union territories for adoption. Published lists of adopting states differ from one another, and none of them names Delhi.

A model law is not Delhi law until Delhi adopts it. Check the Delhi Gazette or ask an advocate before relying on a two-month rule in a dispute.

A different Delhi law appears in older guides, and it does not help either.

Does the Delhi Rent Control Act 1958 cap the security deposit in Mehrauli

No. The Delhi Rent Control Act 1958 does not apply to premises whose monthly rent exceeds ₹3,500, under Section 3(c), and every current Mehrauli listing asks more than that. The lowest rent in current listings is ₹4,500, so the Act’s rules on advance rent do not reach a new lease.

Section 3(c) excludes “any premises, whether residential or not, whose monthly rent exceeds three thousand and five hundred rupees”. The provision came in through Act 57 of 1988, effective December 1, 1988. On August 17, 2026, a Delhi High Court Division Bench applied it again in M/s Harisons v. S. Bhag Singh (RFA(OS) 12/2024) and held that civil court jurisdiction arises only when the monthly rent lawfully exceeds ₹3,500.

Only old tenancies at ₹3,500 or less stay inside the Act. For them, Section 5(2)(b) bars an advance above one month’s rent without the Rent Controller’s permission, and Section 13 lets the Controller order a refund of an unlawful payment on an application within one year.

Whether a refundable security deposit counts as “rent in advance” is a question for an advocate. Guides that say the Act caps every deposit in Delhi do not match the section text.

With no cap to lean on, the case for a lower deposit has to come from the market.

Can you negotiate the security deposit in Mehrauli

Yes, a security deposit in Mehrauli can be negotiated, and the market supplies the argument. One month is the usual ask and two months is the ceiling, so a quote above two months is the first to challenge. A two-month quote is worth trading for written terms.

An extra month of deposit costs less in interest than most tenants fear. At ₹12,000 a month, one extra month earns about ₹688 over an 11-month agreement in a one-year fixed deposit at 6.25 percent.

The real cost is control. ₹12,000 sits with a landlord who may refund slowly, so trade the extra month for terms: a signed inventory, itemised deductions and a refund date.

Direct deals work the same way. When owner and tenant skip a broker, as the guide to renting out a flat in South Delhi without brokerage describes, the deposit is whatever both sign. For the broader monthly side of things, our rent negotiation guide for Mehrauli covers how to lower the monthly lease before you sign.

Once the amount is agreed, how it is paid decides whether it can be proved.

How should you pay and document the security deposit in Mehrauli

Pay the security deposit in Mehrauli by bank transfer to the owner named in the agreement, and take a signed receipt that states the amount in rupees. Put the refund trigger and the deduction rule in the agreement, and photograph every room on move-in day.

Flow of paying and documenting a Mehrauli security deposit in four steps: confirm the rupee amount in writing, transfer to the owner with a remark, take a signed receipt, and sign the agreement with the clause and move-in photos.

Proof is the point. In Mendiratta v. Chawla (RFA 1008/2026, September 28, 2026), the Delhi High Court records a tenant who claimed a ₹10 lakh mortgage or security payment. The trial court found it unproved, and the tenant did not challenge that finding on appeal.

Each step guards one gap. A rupee amount in the message that confirms the flat replaces “one month”, which means different sums on different rents. A bank remark reading “refundable security deposit”, with the reference saved, fixes the purpose and the date.

The receipt carries the flat address, the date, the amount in figures and words, both names and the landlord’s signature. Reviewing a standard lease format for South Delhi residential properties covers the full clause set required to protect your deposit.

On move-in day, photograph each room and the electricity meter with the date visible, and send the files to the landlord. Those photos decide a deduction dispute at exit, which is the next question.

When and how is the security deposit refunded in Mehrauli

The security deposit in Mehrauli should come back when the tenant hands over vacant possession, after itemised deductions. The Model Tenancy Act 2021 sets that trigger, and a widely used clause allows 21 days. For a private flat, the signed agreement sets the real deadline.

Timeline of a deposit refund: notice period ends, joint walk-through and signed handover note, itemised deductions in writing, refund by bank transfer within the agreed days.

The handover date starts the clock, and it can be disputed. In Virender Kaushik v. Satish Jindal (RFA(COMM) 518/2024, March 24, 2026), a Pitampura shop deposit was refundable on handing over possession. Both sides agreed the handover happened and disagreed on the date, December 10, 2020 or February 10, 2021, a gap of 62 days. The Division Bench sent the case back for a full trial.

That was a shop lease, but the lesson carries to a flat. Sign a handover note on the day the keys change hands.

Peeling paint, rewiring, drain cleaning, worn doors and hingesWear and tear, the landlord’s costNothing: decline the deduction

These clauses make the refund enforceable. They are a template for an advocate to review, not legal drafting:

  1. The tenant has paid a refundable security deposit of ₹[amount] on [date] by bank transfer, reference [number].
  2. The landlord will refund the deposit on the date the tenant hands over vacant possession, and in any case within [21] days of that date.
  3. Deductions are limited to unpaid rent, unpaid utility bills and damage beyond normal wear and tear, each itemised in writing with invoices.
  4. Both parties sign a handover note recording the date, meter readings and the condition of the flat.
  5. The deposit is not adjusted against rent during the tenancy unless both parties agree in writing.
  6. A refund after the due date carries interest at [rate] percent a year from the due date.

The sixth clause is a negotiating request, not a legal right, because no source found shows that Delhi deposits carry interest. When a landlord ignores the deadline anyway, the next steps are practical.

What can you do if a Mehrauli landlord does not return the security deposit

If a Mehrauli landlord does not return the security deposit, the usual path has three steps: a written request that cites the agreement clause, a legal notice through an advocate, and a civil suit for recovery. Legal notices commonly give 7 to 10 days, a practice and not a statutory period.

Assemble the file before sending the first message. It holds the agreement, the receipt, the bank transfer proof, the handover note, the move-in and move-out photos and the final utility bills.

A small deposit may be too small for a suit to pay off, which is why the first two steps carry the most weight. A firm request with the file attached, and then a notice, settle many disputes without a court. Time limits apply to recovery claims, and an advocate can state the period for a given handover date.

The Rent Controller route under Section 13 of the Delhi Rent Control Act 1958 applies only to tenancies the Act covers, and rents in current Mehrauli listings sit above that line.

Frequently asked questions

How many months of security deposit is normal in Mehrauli?

One month’s rent is normal in current Mehrauli listings, and two months is the highest they ask. Furnished and high-rent flats are where two months appears. National guides quote two to three months for Delhi overall, so treat three months or more as an outlier that needs a written reason.

Is a three-month security deposit allowed in Mehrauli?

No source found makes a three-month deposit unlawful on a new private tenancy in Delhi, because the two-month limit sits in the Model Tenancy Act 2021, which Delhi has not been shown to adopt. A three-month ask still sits above every current Mehrauli listing, so ask for the reason in writing.

Does the Model Tenancy Act 2021 cap my deposit in Delhi?

Not on the evidence found. The Act proposes a two-month cap for residential premises, but it is a model law that states and union territories adopt through their own legislation, and no published list of adopting states names Delhi. Confirm the current position with the Delhi Gazette or an advocate.

Does the Delhi Rent Control Act 1958 apply to my Mehrauli flat?

Almost certainly not on a new lease. Section 3(c) excludes premises with monthly rent above ₹3,500, and the lowest rent in current Mehrauli listings is ₹4,500. Only old tenancies at ₹3,500 or less fall inside the Act, and an advocate can confirm for a specific flat.

How much security deposit should I expect for a 1 BHK in Mehrauli?

A typical 1 BHK at ₹12,000 a month carries a deposit of ₹12,000 at one month and ₹24,000 at two. Across every flat on the market, 1 BHK deposits run from ₹5,250 to ₹65,199, because rent runs from ₹5,000 to about ₹30,000.

How much security deposit should I expect for a 2 BHK in Mehrauli?

A typical 2 BHK at ₹23,000 a month carries a deposit of ₹23,000 at one month and ₹46,000 at two. Market ranges run up to ₹80,000 for a society apartment and up to ₹46,000 for an independent house. Compact older 2 BHK flats at ₹8,000 to ₹15,000 carry far less.

Do furnished flats in Mehrauli carry a higher security deposit?

Slightly. Two-month deposits appear on fully furnished flats at ₹19,999 or more, but most furnished flats on SouthDelhi Rentwala still ask one month. The quote follows the landlord, so ask for the months in writing and match a higher deposit with a signed inventory.

When must a Mehrauli landlord refund the security deposit?

No Delhi source found sets a binding deadline for private flats. The Model Tenancy Act 2021 proposes refund on the date the landlord takes vacant possession, and a widely used clause allows 21 days. Write the deadline into the agreement and tie it to the signed handover date.

What can a landlord deduct from the security deposit?

A landlord can deduct unpaid rent, unpaid utility bills and damage the tenant caused, such as drilled walls or cracked tiles. Peeling paint, rewiring, drain cleaning and worn hinges count as wear and tear, which the landlord bears. Ask for itemised deductions with invoices.

Should I pay the security deposit in cash?

Pay by bank transfer where possible. A transfer record proves the amount and the date, and a Delhi High Court judgment of September 28, 2026 records a ₹10 lakh claimed security payment that the trial court found unproved. If cash is unavoidable, take a signed receipt stating the rupee amount.
